These General Terms and Conditions (“Terms”) govern the purchase of made-to-measure stainless-steel worktops and splashbacks (“Products”) from Simple Stainless, a trading name of AV Group AB, Överstegatan 2F, 416 57 Göteborg, Sweden (“we”, “us”, “our”). We currently sell and deliver within Finland only. The Terms are available in English and governed by Swedish law.

1. About Us and Scope

1.1 These Terms govern the purchase of Products from Simple Stainless, a trading name of AV Group AB, Överstegatan 2F, 416 57 Göteborg, Sweden (“we”, “us”, “our”).

1.2 Currently, we sell and deliver within Finland only. These Terms are available in English and the governing law is Swedish law (see Section 19).

1.3 By placing an order, you confirm that you are at least 18 years old or have legal guardian consent.

2. Contract Formation

2.1 A binding contract is formed when you complete checkout and receive our order confirmation by email.

2.2 We reserve the right to refuse or cancel an order (e.g., suspected fraud, technical errors, obvious pricing mistakes, or where production is impracticable). If payment has been taken, it will be refunded.

3. Custom-Made Products and No Right of Withdrawal

3.1 All Products are custom-made to your specifications (dimensions, cut-outs, edges, finishes, splashback heights, tap holes, etc.).

3.2 No EU cooling-off right for custom-made goods. Under the EU Consumer Rights Directive 2011/83/EU (Article 16(c)), as implemented in each Member State, consumers do not have a 14-day right of withdrawal (cooling-off period) for goods made to the consumer’s specifications or clearly personalised. All Products are custom-made; therefore the statutory cooling-off right does not apply. Your mandatory rights regarding non-conforming goods remain unaffected.

3.3 At checkout, you will be required to tick a checkbox confirming: “I understand and accept that my order is custom-made and I have no right of withdrawal under applicable consumer law.”

3.4 Your statutory rights regarding non-conforming goods/defects remain unaffected (see Section 14).

4. Drawings, Approvals, and Production

4.1 Order is final at checkout. When you submit your order on our website, you confirm that all specifications (dimensions, cut-outs, edge profiles, finish, tap holes, splashback height, etc.) are correct. The order locks immediately and is treated as a custom-made, non-withdrawable purchase.

4.2 Order Confirmation PDF (for your records). After checkout we automatically email you an order confirmation with a PDF summarising your specifications (“Specification PDF”). This PDF is for information/records only and is not an additional approval step.

4.3 Automatic production start. Production is queued automatically after checkout and payment. We do not wait for any further confirmation from you.

4.4 No cancellations or changes. After checkout, your order cannot be cancelled or changed. In exceptional cases, and only if fabrication has not yet progressed to an irreversible stage, we may at our sole discretion attempt a change; any accepted change requires our written confirmation and may incur engineering/admin and material costs. We are under no obligation to accommodate changes.

4.5 Your responsibility for measurements. Unless we have expressly agreed in writing to perform site measurements, you are responsible for ensuring all specifications are correct. Any remake or adjustment due to incorrect or incomplete measurements is at your cost.

5. Measurements and Responsibility

5.1 You are responsible for all site measurements unless we have expressly agreed in writing to provide a measurement service.

5.2 Please account for out-of-square walls, scribing, and installation clearances. Thermal expansion and uneven walls/units can affect fit; these are not product defects.

5.3 If your measurements are incorrect, resulting adjustments or remakes are at your cost.

6. Tolerances, Finish, and Use

6.1 Standard manufacturing tolerances:

  • Overall dimensions: ±2.0 mm
  • Cut-outs and holes: ±1.5 mm
  • Flatness/warp: within industry norms for sheet thickness; minor deviations that level out with proper fixing/support are acceptable.

6.2 Finish characteristics: Brushed/grain finishes can show directional variation, light hairlines, and minor surface marks from normal fabrication/handling—these are inherent to stainless steel and not defects.

6.3 Stainless steel can scratch in use. Use cutting boards and avoid abrasive cleaners. Avoid strong acids/bleach/chlorides; wipe spills promptly. Heat may cause discoloration; use trivets.

7. Prices, Taxes, and Payment

7.1 Prices and currency. Prices are displayed inclusive of VAT where applicable. The applicable VAT rate is determined by the delivery country and your customer status (consumer/business). The final price, VAT rate/amount, and currency are confirmed at checkout before you pay.

7.2 EU consumer orders (B2C). For deliveries to consumers within the EU, we charge VAT at the rate of the delivery country under the EU One-Stop Shop (OSS) scheme.

7.3 EU business orders (B2B). For cross-border deliveries within the EU to a business customer with a valid VAT number, VAT may be reverse-charged (zero-rated) per applicable rules. You must provide a valid VAT ID and accurate billing details; we may validate VAT IDs and decline/adjust orders if validation fails. Domestic Swedish B2B orders are charged Swedish VAT.

7.4 Outside the EU. If we deliver outside the EU, we do not charge EU VAT. Local taxes, customs duties, brokerage, and import charges (if any) are the customer’s responsibility.

7.5 Payment methods. We accept major cards (Visa, Mastercard, American Express) and may offer Klarna, Stripe, or similar payment services. Unless otherwise stated at checkout, payment is captured at the time of order.

7.6 Pricing mistakes. We may correct obvious pricing or display errors. If you do not accept the corrected price, you may cancel for a full refund.

8. Lead Times and Availability

8.1 Lead times are indicative and communicated in the order confirmation. They may vary based on workload and material availability.

8.2 Lead times and delay remedies (no discretionary cancellation). Lead times are indicative and production starts immediately after checkout. Orders cannot be cancelled due to changes in estimated lead times. If we fail to deliver by an agreed delivery date, you may, in accordance with mandatory consumer law-require delivery and set an additional reasonable period in writing. If we still do not deliver within that additional period, you may terminate the contract for the undelivered Product(s) and receive a refund for those items. The foregoing does not apply where the delay is caused by your act or omission (e.g., missing measurements, inability to accept delivery) or by force majeure; in such cases the delivery period is extended accordingly. We are not liable for indirect or consequential losses (e.g., installer costs), except where mandatory law provides otherwise.

9. Delivery, Risk, and Inspection

9.1 Delivery is curbside or to the first accessible point at the delivery address unless otherwise agreed. You are responsible for moving Products indoors and for safe handling.

9.2 Risk of loss passes on delivery. Please arrange for someone to receive and inspect the shipment.

9.3 Visible transport damage must be noted with the carrier upon delivery and documented with photos. Hidden damage must be reported to us within 48 hours of delivery with photos of the packaging and the damage. Failure to notify in time may affect your right to a remedy against the carrier.

9.4 If a shipment is not collected and returns to us, we may charge actual return freight and handling.

10. Storage and Installation

10.1 Store flat on a level surface, indoors, dry, and protected until installation.

10.2 Installation must follow good practice: adequate support, correct fixings, careful handling, and proper sealing/scribing. Damage or distortion arising from improper storage or installation is not a product defect.

11. Changes, Errors, and Misprints

11.1 We may correct obvious errors (e.g., pricing, typographical, or technical). If you do not accept the correction, you may cancel for a refund.

11.2 Product images are illustrative. Actual grain direction, sheen, and color tone may vary.

12. Order Limits and Anti-Fraud

12.1 We may limit or cancel orders per person/household/account to prevent abuse or fraud.

12.2 We may verify information or request additional confirmation before production.

13. Retention of Title

13.1 Products remain the property of AV Group AB until paid in full.

14. Non-Conformity, Warranty, and Remedies (Consumers)

14.1 If a Product is non-conforming under the Swedish Consumer Purchases Act, you are entitled to remedies in accordance with mandatory law.

14.2 Notify us within a reasonable time after discovering the non-conformity. A notification within two months from discovery is always deemed timely.

14.3 The complaint right applies for up to three (3) years from delivery.

14.4 Our first step is to rectify the defect or replace the Product within reasonable time and without significant inconvenience to you. If that is not possible, you may have the right to a price reduction or to cancel the purchase per law.

14.5 Normal wear, installation errors, site irregularities, misuse, chemical damage, and aesthetic variations described in Sections 6 and 10 are not defects.

15. Liability

15.1 We are liable for losses required by mandatory law.

15.2 Otherwise, we are not liable for indirect or consequential losses (e.g., loss of time, business interruption, installer costs, or other third-party charges), except where mandatory law provides otherwise.

15.3 Nothing in these Terms limits liability for intent, gross negligence, death, or personal injury.

16. Force Majeure

16.1 We are not responsible for delay or non-performance caused by events beyond our reasonable control, including but not limited to strikes, lockouts, accidents, pandemics, transportation disruption, fire, flood, extreme weather, war, cyber incidents, supplier failures, or legal/regulatory actions.

17. Third-Party Tools and Links

17.1 If our website references third-party tools or links, they are provided “as is”. We are not responsible for third-party content or terms.

18. Personal Data

18.1 We process personal data in accordance with our Privacy Policy and applicable data-protection laws (including GDPR). See our Privacy Policy for details on purposes, legal bases, and your rights.

19. Governing Law and Disputes

19.1 These Terms and any purchase are governed by Swedish law.

19.2 Consumers may submit disputes to the National Board for Consumer Disputes (ARN) (www.arn.se) and may also use the EU ODR platform (https://ec.europa.eu/odr). We follow ARN’s recommendations.

19.3 For B2B customers, disputes are exclusively settled in the Gothenburg District Court (Göteborgs tingsrätt).

20. Updates to the Terms

20.1 We may update these Terms from time to time. The version in force at the time of your order applies to that order.
